What you actually own when you buy through EXANTE
A price comparison stops at the commission. This page starts after it: whether the trade leaves you holding a security or a contract, whose name that security is registered in, and what the document EXT Ltd (Cyprus, CySEC 165/12) publishes says becomes of it if the firm fails.
Which entity and which product this covers
Applies to EXT Ltd, the Cypriot entity licensed by CySEC under number 165/12, under Terms of Business v9.0 (07.25). This document never states in as many words that the client acquires title to the securities; what it does state is that EXT executes orders for and on behalf of the client and not as principal, and that it segregates client assets from its own while pooling them in an omnibus account. It also puts retail clients' financial instruments outside title-transfer collateral arrangements. LHCM Ltd and XHK Limited, the other entities behind the EXANTE brand, publish separate terms that were not read here, and whether this entity sells contracts for difference on shares was not established.
Do you own real shares when you buy through EXANTE?
A real security — but not one registered in your name. EXT Ltd (Cyprus, CySEC 165/12) holds client investments through a nominee or custodian, pooled in an omnibus account together with other clients. You are the beneficial owner: the shares are yours rather than the firm's, but they are not separately identifiable as yours in the register.
“EXT will segregate Clients' Assets from assets belonging to EXT; provided that Clients' Assets may be placed or kept in a common pool of identical assets or otherwise deposited in an omnibus clients' account.”
What happens to your holdings if EXANTE fails?
Here is what EXT Ltd (Cyprus, CySEC 165/12) says in its own document, in its own words — including the part that qualifies it.
The counterweight in the same document
“You acknowledge that your assets may be placed or kept in a common, omnibus or client account of EXT or any Delegate or are otherwise commingled with assets belonging to other customers, and that if there is an un-reconcilable shortfall in any such account, you may have to share in that shortfall.”
Can a loss at EXANTE follow you past your balance?
Not as a retail client of EXT Ltd (Cyprus, CySEC 165/12) — negative balance protection caps your loss at the account balance. That protection is tied to retail classification: if you ask to be reclassified as a professional client, it goes away. One qualification: EXT Ltd's Risk Disclosure states the protection conditionally: it applies to retail clients “under certain circumstances”, and then only “if so provided by the competent financial market supervisory authority within national product intervention measures”. It is not written as an unconditional guarantee covering everything in the account.
